forgetmenot is offered by Zugzwang Studios (Luis Arnold), Oberwilerstrasse 157, 4054 Basel, Switzerland. It lets you record, write and bring in the stories of your family, has them written down and put in order, and lets you read, explore and download them.
You need an account with an email address and a password. Keep the password to yourself. You must be at least 18 years old.
Everything you add belongs to you. We use it only to provide the service to you: to keep it, write it down, put it in order and show it to you. We do not sell it, do not show it to others and do not use it for advertising.
You can download everything at any time, on every plan, and you can delete single stories or your whole account at any time. A deleted story first goes to the trash, where it can be restored for 30 days; then it is deleted for good. You can also delete it for good at once.
There are three plans. The current allowances and prices are shown in the app under "Plans" and on the front page of forgetmenot.
A week starts on Monday. What is not used in a week does not carry over, and deleting a story does not give the week's allowance back. Stories in the trash count towards the Demo's total until they are deleted for good.
Every plan is meant for one family's stories. To keep the service affordable for everyone, each plan also has a daily limit on how often stories can be written down, read or put in order; normal use does not reach it. Automated or bulk use is not allowed.
The price shown in the app before you subscribe is the full price you pay. Payment is handled by Stripe; on the payment page and on your statement the seller appears as Zugzwang Studios. A subscription runs for one month, or for one year where you choose to pay by the year, and renews for the same time until you cancel it.
You can cancel at any time in the app (Account, "Plan and billing"); the plan then stays open until the end of the month or year already paid for. You can also change between the paid plans there, and between paying by the month and by the year. A change applies at once. What you have already paid for the rest of the running month or year is counted towards the new plan: going to a larger plan, you pay only the difference for that time, and going to a smaller one, the difference is credited to your next payments. It is settled with your next invoice; a change between monthly and yearly payment starts a new period and is invoiced right away.
Nothing is deleted and nothing is locked. Everything you have kept stays readable, correctable and downloadable. Only adding beyond the Demo's limits pauses until you subscribe again.
If you subscribe as a consumer, you can withdraw from the contract within 14 days of the day you took out the subscription, without giving a reason. To do so, tell us in a clear statement before the 14 days are over, for example by email to zugzwangxstudios@gmail.com. You can use this wording, but you do not have to:
To Zugzwang Studios, Luis Arnold, Oberwilerstrasse 157, 4054 Basel, Switzerland: I withdraw from my contract for the forgetmenot subscription taken out on [date]. [Your name, the email address of your account, the date.]
If you withdraw, we pay back everything you paid for that subscription, within 14 days of receiving your statement and in the way you paid. We make no deduction for the days you used the service. Your account goes back to the Demo; nothing you have kept is deleted.
The right of withdrawal applies to the first subscription and to a change to another plan, not to each renewal. After the 14 days you can still cancel at any time (section 6).
Recordings are written down and stories are put in order by software. It makes mistakes: words can be misheard and details misunderstood. You can correct every text. A document itself is not kept by us once it has been read, and a recording only on the plan "No time to lose" (there you can listen to it again and download it); on the other plans it is removed once it has been written down. If you want the file, keep your own copy. Please do not rely on the automatic text where exact wording matters.
We work to keep the service available and your stories safe, but we cannot promise that it will never be interrupted. We recommend downloading a copy of everything from time to time.
We are liable without limit for damage we cause on purpose or through gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited.
For slight negligence we are liable only where we break a duty that is essential to the contract (one you may rely on, such as keeping your stories), and then only for the damage that could typically be foreseen. Otherwise liability for slight negligence is excluded. In particular we are not liable for mistakes in the automatic text (section 9), or for a loss you could have avoided by keeping your own copy of a recording or document that we do not keep.
The service is provided over the internet and through other companies' systems. We are not liable for interruptions outside our control.
If we change these terms in a way that matters, we tell you by email at least 30 days before the change applies. If you do not agree, you can cancel and take everything with you.
Swiss law applies. If you are a consumer living in the European Union or another country whose law protects you in ways that cannot be set aside by contract, that protection stays yours. The courts of Basel, Switzerland are competent; as a consumer you can also go to the courts where you live.
We do not take part in dispute resolution before a consumer arbitration board, and are not obliged to. Write to us first: most things can be settled directly.
